How critical & simple argument is labelled blasphemy and awarded capital punishment?
Section 295C Whoever by words, either spoken,or written,or by visible representation,or by any imputation, innuendo or insinuation, directly or indirectly,defiles the sacred name of Holy Prophet (Peace be upon him),shall be punished with death or imprisonment for life and shall also be liable to fine.
Section amended on 1991 ,removed the alternative punishment of imprisonment for life, making death penalty mandatory for offence.
Wanton vilification and deliberate attack upon the founder of any religion is considered crime and punishment should include proper inquiry of the matter ,with evidence included and involvement of Fiqh to address punishment, considering both Muslim and non Muslim offender respectively.Bonafide and honest criticism should be encouraged, as it involves brain to think critically , ultimately deepens the Faith when answered.
What harm 'amended 295C' brings is it removes the very 'intent' which is involved in Fiqh. This section was inspired by British colonial sedition law, imprisoning and punishing people in name of war crime. This section being misused since then,is now involving famous names as Mashal khan of Baacha Khan University ,Engineer Muhammed Ali Mirza and many more.
Blasphemy has now become a matter of how offended someone feels. Ikhtilaf, difference of opinion, and honest criticism when represented as direct or indirect blasphemy without knowing a person's intent not only lead to hatred, contempt and humiliation,but also can be as horrible as justifying killing of a human being.
When only those Quranic ayat and Ahadees are put forward favorable to a person's bias, in the name of Islam , it's effects not only devastate the individual but the whole community with widespread disaster in the world unless repented and rectified.
